Parking M923 in Glendale, AZ Residential Neighborhood

Forgive me if I have posted this in the wrong thread.

I just received a Code Enforcement Action from the City of Glendale Neighborhood Services Department for my 5-ton that I have had parked on the side of my house for the past 8 months.

It states no parking of commercial/overweight vehicles allowed in residential neighborhoods. It is registered as a commercial truck, but I have Recreational Vehicle insurance on it. My neighbor down the street has a 52 ft motorhome that has commercial plates on it. State of Arizona registers large trucks/vans/vehicles as commercial because of GVWR or passenger capacity. City of Glendale does not see the 5-ton as might be defined as an RV.

Anyone else on here have any issues with City of Glendale, Arizona on keeping their military vehicle on their property?

It is in running condition and I take it out and exercise it twice a month. The lady that wrote the citation said they received "several" complaints about it. We do have a couple of retired "busy bodies" on the block that do nothing but file complaints with the city. There is no HOA in my neighborhood.

Any advice? The storage facility near me won't store it because of its size.

Make life very hard for the aforementioned "Busy bodies". Be creative.

You can talk to a lawyer but the way that is written makes me think you will lose. The fact that they have not ticketed everyone may not help, they may just take your list of other vehicles and write more citations.

Look for a RV storage facility near you, or better yet move. Hope this does end well for you, and some of these fights have been won but it will cost you money either way.

Move or find a storage lot or sell the 5 ton and get a CUCV.

Sorry no help on the Glendale question but All I have to say is it must be the season for it.....I too had a visit from my city's code enforcement last night as I guess they have a rule on the books saying "nothing over 12k parked within neighborhoods" (it's ok if it is being loaded or unloaded) but can't be "parked" I said Ok...I'll move it into my private property driveway and he proceeded to say "no still not allowed"...I said Ok..I wasn't aware of the code and I'll move it over to my shop/storage place where it usually is...Then he proceeded to say "well it's been here for a week now"......Ahh the lightbulb goes off! (I have had it at my home many times for multiple days at a stretch but this is the first time I have had it at the house for a week without driving it to work or somewhere as I had it at home for the Memorial weekend events I participated in and planned on attending a show this weekend so figured I would just keep it at the house)

I now had a good idea of who it was that complained (as he wouldn't tell me who of course) as they live a little bit further up the street so I said Ok you don't have to tell me...Then I asked him "I assume your notifying everyone on the block about their Class A motor-homes & the commercial tow truck & all of the trailers/boats etc too right? He proceeded to say "well I haven't been told of a complaint at any other address in this neighborhood".....I replied..."Well...you have now for that home" with a smile then we exchanged other pleasantrys and bid him farewell. I then proceeded to grab my keys and start up the beast so I could start doing my pre-drive checks as I watched him move on up the street stopping at the place I pointed out to him (Yes the worse offender and whom I am sure is who complained).... Anyways... I drove up the street past this house and he was out side looking around at all his toys that he now has to move them and I just hit the air-horn and waved as I turned around in the cul-de-sac...

(Back-story on what I think started this)
Pretty sure he was the one who complained as his is the only one in that has made snide comments about my Beast as well as about the others on the block who have parked larger vehicles/trailers at times for more than a few days straight (He got pissy over the Memorial holiday as he was taking his huge Class A & boat out of the neighborhood and my neighbor across the street was having a BBQ and so he had a bunch of cars/trucks parked in front of his home which of course narrowed the street with my lifted F-250 and the Beast in front of my home) But there was still plenty of room to pass by (just not two way traffic)...

I am pretty much "O-well" over this but I'll still bring my Beast to the house periodically from the shop/storage location like when I'm going to be going to a car/truck show etc the next day or so and if keeping it at the home overnight I'll just park in my own driveway as "It was bedtime for my neighbor so I ran out of time loading/unloading stuff and just wanted to wait until the next morning to be a nice neighbor so I wouldn't keep them up as I moved stuff around in the dark" But now until Winter-parking rules kick in (All night parking is prohibited from November 1 to and including April 1. No person shall park a vehicle on any street for a period of time longer than thirty (30) minutes between the hours of 11:00 pm and 6:00 am of any day, and during any period of snowfall when snowplows may be operating.) my F-250 will be always parked on the street now (since it's well under the 12k rule) where as I used to mainly park it in the driveway... so the street will be just as narrow as it was this past week! LOL

Hahaha, Mtnsnow(Mike) knows how to play the game. For me at least my neighbors want to come check out the "Zombie Outbreak Response Team" truck.

I'd say find a storage lot that allows RV's. If the code is stated like you spelled it out on here it may be cut and dry. In Kansas city, MO you can't keep a large vehicle parked in a residential area for more than two hours.

I have spoken to all of the neighbors that are close to me and they all have praised me on how good the Beast looks & thank me for my service etc....Just that one idiot..... BUT I just got done looking up the actual city codes. I think I can actually park my Beast if I so choose to as it is does not fall within a "restricted vehicle" But I & my wife also friends with our Chief of Police and most of our police force so I'll ask for a "parking permit" for conditional (sporadic) usage so I don't keep bugging them for a "new" one lol

6-1-3: WEIGHT LIMITATION OF RESTRICTED VEHICLES ON PUBLIC STREETS

A. No vehicle or combination of vehicles shall be driven on the streets of the city which have a maximum gross weight in excess of nine thousand five hundred (9,500) pounds on one wheel, or an axle load in excess of twelve thousand (12,000) pounds, except with the permission of the city council.

B. No vehicle or combination of vehicles shall be driven on the streets of the city in excess of the maximum gross weight or axle load posted on the street if the posting was authorized by the city council.

C. As used in this section, "axle load" means the total load on wheels the centers of which are included between two (2) parallel transverse vertical planes. (1989 Code § 11-324)

D. Any person that violates this section is guilty of a class C misdemeanor, subject to penalty as provided in section 1-4-1 of this code. (1989 Code § 11-324; amd. 2012 Code)


But here is the Code that should have been actually mentioned.

6-2-6: BOATS, TRAILERS, RECREATIONAL VEHICLES, LARGE TRUCKS AND OTHER OBJECTS DEEMED SAFETY HAZARD:

A. Prohibited Parking: It shall be unlawful for any person to park or allow to stand on any public street or right of way in the city any boat, trailer, camper, recreational vehicle, motor home or truck (except a pickup), for more than twenty four (24) hours without a parking permit issued by the police department. (1989 Code § 11-381) NOTE - So Technically as long as I drive it at least daily I am good to go even without a permit!

B. Heavy Trucks Limitation[SUP]2[/SUP]: No person shall, without a parking permit issued by the police department, park or allow to stand on any public street or right of way in the city any truck weighing twelve thousand (12,000) pounds or more, unless the truck is being actively loaded or unloaded. For purposes of this section, a truck shall not be deemed to be actively loaded or unloaded if: 1) nothing is removed from or placed in the truck for a period of time in excess of ten (10) minutes; or 2) the truck is blocking or impairing the flow of traffic. (1989 Code § 11-382) NOTE - Technically/Officially the Beast does not fit the listing of a heavy truck (doesn't have 10 or more wheels &/or does not have an Axle weight greater than 12k as listed by the footnote #2)

C. Hazard Created: It shall be unlawful for any person to park any motor vehicle in the public streets or right of way in city which:
1. Creates a hazard;
2. Reasonably impedes the flow of traffic;
3. Impairs the operation of city equipment or vehicles; or
4. Unreasonably prevents or obstructs other drivers of motor vehicles from viewing the road or road right of way. (1989 Code § 11-383; amd. 2012 Code) NOTE- This could be applied to pretty much any and all of the vehicles/trailers/RVs etc that are parked on the street if you wanted to get nasty about it...

D. Removal Of Vehicle: The police department, after making a reasonable effort to notify the owner or driver of a motor vehicle which is in violation of subsection A or C of this section, may remove or cause to be removed, the vehicle or object. (1989 Code § 11-384)

E. Penalty: Any person that violates any provision of this section is guilty of a class B misdemeanor, subject to penalty as provided in section 1-4-1 of this code. Each day that a violation of this section continues or occurs, shall be deemed to be a separate offense and may be punished as such. (1989 Code § 11-385; amd. 2012 Code)

My neighbors 52 motorhome has a dry weight of 21500 lbs. My 5-ton dry weighs in at about 16000. I hope they do something about his motorhome as it overhangs the sidewalk by about 4 inches.

There are two of them that we know of. Could be more.

Last year we had an issue with a house flipper that was going around looking over back yard fences and reporting every minor nuance within a property. I received over 20 code violation notices in one week. Many of my neighbors also received many notices. The City Enforcement Office finally had a enough and stopped taking complaints from the flipper once I told her that they didn't live in the neighborhood and they were only flipping the house.

Unfortunately, Glendale city code is not cut and dry on this issue. It is very vague. If you follow the letter of the law for Glendale, it is against the law to even park a dually 1-ton in residential neighborhoods.

Not bobbed, but the state has it down as weighing 16000 lbs in DMV records.

Sounds like the weight needs to be corrected , if the D.O.T. puts in on a set of scales it most likely will be a hefty fine for incorrect weight .

All my neighbors know I'm crazy enough if they complain they will find their respective cars underneath the truck.

Although, I don't live in a HOA, the chief of police lives down the street, and I'm 3rd generator fire fighter so I'm known well in the town, plus I'm certifiable crazy, lol

I can't wait to get my 11.5 acres, oh I will be so happy.

I hate to say this but you are in a very socialist part of the country. Not many places left without a million rules. Freedom and Liberty is eroding every day. Why not run for city council. Then you could push to change the law

My soon to be X neighbor is a DOT officer. He is one of the good guys and we talked a lot about out years in law enforcement. Unfortunately he is moving and I am not so sure how the next neighbor will like my 923 parked between the houses. Good luck nd I am serious about running for office. I got the same letter but it was from phx. I talked to the neighborhood services guy and explained that it was registered and insured an a classic/ antique military truck. He said that was fine and tree was nothing they could do, and he would close the case as put a mark down not to react on any further complaints about it.
