By that wording it sounds like they would require every 1-ton pickup being driven by a mom bringing a swingset home for her kid to stop. The sticky point is the term "used in commerce". What is considered commerce? Thats pretty much up to the DOT and the judge. The owner of the truck is hauling a load for someone else.
