I like the idea of using the media to help you out. Call all the local VFW's, news, papers, VA orgs, ect. Dont let those PC politicians take your rights from you, once they start they wont stop.

Trust me, I had the media help me in many occasions when it came to HOA problems involving my company. By the way, we won all the fights and embarrased those PC pricks to shame on live TV.

Our local Channel 4 might help. We would need some well maintained M1008's or M1009's to show that they are pretty much just like their civilian counterparts. Not loud, smokey, or falling apart. We may not be able to get a compromise on deuces since they are so big but we might get them to ease off on the pickup/SUV sized MV's. I don't own a CUCV so I am no help in the application, just had the idea.

Actually, I would have a deuce there and a F350, as there is only a couple feet difference between the 2 vehicles.

1. Go to said City Counsel meeting and ask why the prejudice against the miltary and its historical vehicles significance
2. Continue to go to the meetings!!
3. After the "leaders" on the Counsel realize that you are passionate about this, request that the ordinance be change.
4. If the "leaders" are unwilling to change, repeal the ordinance, find out what it takes to get the issue on a ballot for the citizens of the community and then get on T.V., radio, web and whatever other medium to get the word out!!
5. BE POLITE, but be Tactically efficient!!
6.MOST IMPORTANT POINT NEVER MAKE IT PERSONAL!!!!

That law sounds like it violates the State Constitution.

A municipality may restrict certain vehicles based on width, weight, etc. But they cannot reclassify commercial vs non-commercial.

A good lawyer & a class-action-lawsuit would be in order. The city is acting outside of their jurisdiction.

State DOT should be contacted to verify the city can do this. Also, a DOT specialist lawyer should be consulted.

I've worked in OPKS for many years and have been always surprised by how people sometimes act there.. but what he stated above is true, I dont think they can "reclassify" a vehicle that the state already has laws on the books for. especially if they state "replicas" etc...

Good Post and some good suggestions...

At least he does have a place to store his MV,, if not, I live just 45 se of KC... and have some room...

When/if folks start working on getting this reversed, going out all blood-thirsty and pissed off isn't the way to do it. You'll just immediately ruin any chance of any body helping you fix anything. Try to understand what the folks who passed it were concerned about, and work on assuaging their concerns and helping them realize how this legislation is unnecessary. "Wisdom, justice, and moderation"--those three things are incredibly important with any dealing like this. Unfortunately they are the first three things to go out the door with almost 100% of all political dealings...

I agree. It is frusterating because they lumped all MV's together and said they are all out. I don't think they did any research. Someone probably complained about a "bid Army truck" down the block and the city council jumped up and said no MV's not realizing some are just basic models of civilian production vehicles. It is fun to slam the dumbies but I'm sure it will be handled in a calm manner. I don't live in OP so I can't do much.

I'm just up the road here, smaller town, semi-rural...I have a Vietnam vet directly across the street, a former reenactor/ MV guy next to him, and a former Military man next to me...and they absolutly love my stuff..70 deuce and 86 cucv M1009. ..so no problem here .....for now anyway. I have heard of an ordanance being discussed here to ban( I do hate that word) any vehicles being parked in yards . I do not know what has become of this as of now.

We have a couple of local codes, but nothing that singles out military vehicles. You cannot park a vehicle in your front yard, defined as the portion in front of the corners of the house that face the street, unless that is paved or a gravel driveway.

You cannot park or store inoperative vehicles in your yard, that one is kind of strange. They do not have to have current registration, they just have to run.

You cannot park a vehicle on the public street that is inoperable or does not have current registration. They also have to be moved every 24 hours. Not a problem for me as I do not like to park in the street because my MVs are too hard to see at night and we get too many parked cars struck anyway.

I am lucky in the the front of my house faces 5th street and the back of my house faces 4th street, so I have driveways off of both streets and easy access to my garage. When the garage was built, we put overhead doors in both ends so Dad could pull his bass boat straight through instead of trying to back in off of the street. Not that backing in was a problem, it is just much safer to wing into the driveway and pull through. Glen

So would a civilian HUMMER painted dark green be objectionable? If I had one I'd sure loan it to you to park there for a few weeks to see if it gets a ticket, then challenge them in Court for harrassment, as it was never a military vehicle.
I could see them possibly banning parking on the street, but once it's in your driveway I'd be the type to tear the ticket up in the guys face to watch the reaction...
They are definitely illegal in State law somewhere, you just need to find out where then pursue fixing it, or whenever you drive home in one you will end up getting a violation, etc. Can't let them gain a foothold here, they won't stop.

Tis is issue seems to be a growing issue amongst us who live in incorporated areas and "bigger" cities that allow POA's or HOA's to "rule" over there subjects. My POA recently requested an ordinance prohibiting the parking of ANY vehicle in the front of a house or at the side of the house on "un-improved" ground. I got notice of the hearing, wrote my complaint to the city counsel and took a half day off work to attend the meeting. Long story short, the ordinance was denied on the grounds of objections of homeowners! @ out of 350 homeowners showed up to the meeting!!!!

I agree with moderation here. I made friends with most of our city counsel and mayor. They wouldn't do anything that would hurt the deuce.

A busy body neighbor one block down complained about it and tried to get my deuce banned. Shot down as soon as it was mentioned.

Usualy, a municipality can regulate street parking within it's jurisdiction, based onthe state's MVD defenition of that vehicle's registration, and they normaly do no reinterpret( reinvent their own defenition diferent from one alredy made by the state MVD). In Most steate antique or Historic vehicles are exempt from most municiple rules, as long as they are titled and registered in that state in that way. I am not familiar with the Kansas laws, but that is a good angle to look at for making a chalenge to a stupid ordinance, it can not prevail if it is against state law regulating vehickels there. As for cities and counties all over trying to enact ordinances to control and greatly limit your use of your own property "for the good of the comunity, or greater common good" is as old as early 1900's. It has reached it peak in China, and it is called Communism, there, there is a rule on how many kids you wil have , and if you have more than is "Alowed" they wil fine you, and or force an abortion, or if it is toolate, will take the child away and realocate that child to where the state feels wil properly serve the common good, as such is determined by the state. All local ordinances here start as "resonoble regulations", with only warnings and provisions for voluntery compliance, then the financial penalties are added, then civil fines and later criminal charges, for non-compliance. Just for example, a friend of mine in Glendale AZ, has gotten the city on his case, for a shade tent in his back yard, behind a 6' block fence. A notice to remove or face civil and criminal charges of a misdemeanor, (first offense), and a fine of $350.00-$ 3000.00, depending on the feeling of the case manager from code compliance. This is new and it is retroactive. We went to the compliance office to find out if there was a complaint, but were told that since this year is a budget crunch, 74% of all of their cases are self generated, to raise $$, case workers troll the neighborhoods, looking for what would be a fineable violation, and write a ticket for it. If it is not paid within 10 days they lean the homeowner's property, if not paid then, they will proceed to foreclosure, and criminal charges against the owner, by default. Needles to say, the shade tent came down the same day, and my friend is looking to move from city of Glendale, which used to be a nice and easy place to live until "proactive management" got in somehow.
City of Glendale is too large and too complex politicaly, but for smaller more traditional municipalities there is still hope to get interested locals involved, and do not let "reasonable Regulators" overtake and slowly subvert your comunity. Sorry for the digress.

I have a friend with a 24 hour glass repair bussiness, He came to my house to talk to me. Was at my house for about an hour.
3 days later I have the Code Enforcement Cops at my door demanding to see my permit for replacing my window. I never replaced any windows.
The jerk down the street who is nosey as can be turned me into them.
I thought about it a minute and then asked who turned me in, they coundt tell me. So I asked again after showing my badge to him. WOW he changed his mind quick and told me who turned me in and also others he ratted on. I had that guy arrested, and filed an illegal conduct report on him. He wont be bother me or anyone else again. 99% of the people he turned in month after month were all innocent.
People need to mind their own bussines and the world would be much better off. Espically those PC people
